Car Mart Direct Pty Ltd (ABN 57 164 645 050) trading as Car Maxx (“Car Maxx”, “we”, “us” or “our”) is committed to complying with the Privacy Act 1988 (Cth) and the Australian Privacy Principles in relation to the collection, use, storage and disclosure of personal information. This Privacy Policy describes how Car Maxx collects, holds, uses and discloses personal information in connection with the operation of its vehicle subscription services, website and related business activities.

By applying for, entering into or continuing a subscription arrangement with Car Maxx, using our website, or otherwise providing personal information to us, you acknowledge that you have read and understood this Privacy Policy and consent to the collection, use and disclosure of personal information in accordance with its terms.

Car Maxx collects personal information that is reasonably necessary for the purposes of assessing eligibility for subscription services, verifying identity, administering subscription agreements, processing payments, managing customer accounts, enforcing contractual rights, protecting vehicles and other business assets, managing operational and financial risk, complying with legal obligations and otherwise conducting its business operations. The personal information collected may include, without limitation, a person’s name, date of birth, residential address, contact details, driver licence information, identification documents, subscription application details, payment method information, transaction history, communications with Car Maxx and any other information reasonably required for the administration of a subscription arrangement.

Personal information may be collected directly from individuals when they submit a subscription application, communicate with Car Maxx, use our website, interact with subscription management systems or otherwise provide information to us. Personal information may also be obtained from third parties where reasonably necessary, including identity verification providers, credit reporting bodies, payment processors, insurers, government authorities and other service providers involved in the administration of vehicle subscription services.

Vehicles supplied under a Car Maxx subscription arrangement may be fitted with telematics or other monitoring technology. Such systems may collect or transmit information relating to the vehicle while it is supplied under a subscription agreement. By entering into a subscription arrangement with Car Maxx you acknowledge and consent to the existence and use of such technology for operational, compliance, safety, enforcement and asset protection purposes.

Car Maxx uses third party technology platforms and service providers to administer vehicle subscription services. Personal information may be disclosed to and processed by such providers where reasonably necessary for the purposes of identity verification, account administration, payment processing, risk management, fraud prevention, enforcement of contractual obligations and the protection of vehicles and other business assets. In circumstances where an individual has engaged in conduct that presents a material operational or financial risk, including serious breaches of subscription agreements, fraud, non-payment or misuse of vehicles, Car Maxx may disclose relevant information to authorised platform operators or service providers for the purpose of managing operational risk, preventing fraud and protecting subscription fleets and other assets. Any such disclosure will occur only where reasonably necessary for the operation of subscription services and the protection of Car Maxx’s legitimate business interests.

Individuals acknowledge that information relating to serious contractual breaches, fraud, non-payment, vehicle misuse or other conduct presenting operational risk may be shared with authorised service providers or platform operators for legitimate risk management purposes. To the extent permitted by law, such disclosure made in good faith for the purposes of fraud prevention, risk management or asset protection does not constitute a representation as to fault, wrongdoing or liability and is made solely for legitimate commercial and operational purposes.

Car Maxx may disclose personal information to third parties where reasonably necessary for the provision of subscription services or the protection of its legal rights and business interests. Such third parties may include technology providers, payment processors, roadside assistance providers, insurers, repairers, recovery agents, professional advisers, credit reporting bodies, debt collection agencies, government authorities and law enforcement agencies.

Where an individual fails to comply with payment obligations or otherwise breaches the terms of a subscription agreement, Car Maxx may disclose information relating to that default to credit reporting bodies or obtain credit reports for the purpose of assessing credit risk or recovering outstanding amounts. Such disclosures will be made in accordance with the Privacy Act 1988 (Cth) and applicable credit reporting legislation.

Car Maxx may use contact information provided by individuals to send communications relating to subscription services including operational notices, account notifications, compliance communications, payment reminders and other information necessary for the administration of subscription arrangements. Subject to applicable laws including the Spam Act 2003 (Cth), Car Maxx may also use contact details to provide information about products, services, promotions or offers that may be of interest to customers. Individuals may opt out of receiving marketing communications at any time.

Car Maxx takes reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure. Personal information may be stored electronically on secure servers or cloud-based systems and access to such information is restricted to authorised personnel and service providers who require the information to perform their functions.

In some circumstances personal information may be stored or processed by service providers located outside Australia. Where personal information is disclosed overseas, Car Maxx will take reasonable steps to ensure that the recipient handles the information in a manner consistent with Australian privacy obligations.

Individuals may request access to personal information held by Car Maxx and may request correction of that information if it is inaccurate, incomplete or out of date. Car Maxx may require reasonable verification of identity before providing access to personal information.

If an individual believes Car Maxx has breached the Privacy Act or mishandled personal information, a complaint may be lodged with Car Maxx and the matter will be investigated and responded to within a reasonable period.
